The state law clearly permits requests for manual recounts in cases of machine malfunction. The Republicans are currently arguing that the law refers only to gross machine malfunction (the law does not clearly state this). The Democrats argue that if the margin of advantage for one candidate is less than the machine's error rate, that is malfunction enough. Clearly, the Florida Supreme Court will have to decide which interpretation is correct. The presumption of the Florida electoral law, as in many other states, is that in a last resort hand counting is the most accurate way to go.
