I didn't say that is was a judicial process. I was extending the concept to you. Making it easier for you to understand. As the court does have an element of the argument claiming selective counts to be unfair, it is a certainty that such an idea will be considered by the court whether use it or not.

Arbitration is a judicial process, and arbitrators are officers of the court. The process is governed by state or federal arbitration law.
