Undoubtedly the Bush campaign recognized it couldn't demand a manual recount in smaller, predominantly Republican counties without legitimizing the recount in the larger, predominantly Democratic counties. That's a real dilemma they faced, and the Florida Supreme Court also addressed this question. It sounded to me like the justices were uncomfortable with the idea that NO MANUAL RECOUNT should be allowed if the results didn't get to the Secretary of State by the time she had set initially. And in fact, as the hearing wore on, the justices seemed to be asking more questions on whether a manual recount would still be legitimate if the Secretary of State were able to certify, say, a week before December 12 (the day the results must be reported to the electoral college and the electors selected).

I had initially thought it might be possible to authorize a new vote in Palm Beach County, but the December 12 date makes this impossible. I now think the Florida Supreme Court will come out with a decision that reconciles the ambiguities in the Florida statutues and achieves perhaps not a perfect solution but one which is closer to recognizing all legitimate votes.
