Sec 168 is the contest provision, if AG is correct Dec 12 is the date for EC certification, date wat which all problems must be resolved. Will Bush have to contest the 168 decision? The votes in the middle (disputed) are resolved by the county board, and the courts deal with any contest. Boies is clever -- "clearly within the power of this court in order tyo meet Dec 12 you must have the votes county by some date, and then the contest is allowed a certain time." Court's judgment in these matters. Judge Harding asks if legislature declared time limes, Boies denies leg made a fixed limit for official returns. Court seems to following Boies model which leaves 22 days or so the fix things. Boies suggests a plan which will be easy for the court to fix the dates. Boies argues SOS if purely ministerial. Boies says that as long as manual recounts will not violate Dec 12. SOS Discretion is limited to setting a reasonable date. Court needs to act expeditiously to set the dates. Boies is clearly explaining to the judges what they need to know in order to rule his way. The ballot marking cases from Mass and Illinois. Any cand could have requested a recount. SC should be as specific as possible.
