Yes but that is what the procedure should be rather than to have a panel of judges taking the role of the SOS, very dangerous IMO.

There are too many possibilities at this point to even make a reasonable guess about the outcome. The ordinary course of argument is:
I'm innocent
I wasn't there, I've got an alibi
Someone else could have done it
It was an accident
I didn't mean to hurt him
He provoked me
He was a really rotten guy and deserved it

You fight each battle and fall back to the next line; no one expects a lawyer to sink or swim with the first argument.
