Dr. Voodoo, I'm sure that if the FSC overturns Harris's discretion, Bush will appeal to the US Supreme Court, but since the case will turn on State grounds the USSC can easily decline to hear it since they need not address state questions. As for Federal constitutional questions, I'm not sure that there really are any in this case which is simply a question regarding the deadline for submitting results, and on how much discretion the Secretary of State has.
