I said prior to the Florida Supreme Court hearing that there was only one thing they could do and only one ruling they could make. If the law matters at all here, they must support the action taken by Secretary of State Katherine Harris. This case gave us a chance to find out whether the Florida Supreme Court is a court of the law, or whether the members of this court are political hacks. Because the law here is crystal clear, and the circumstances surrounding the law are crystal clear. The things that have happened regarding these recounts, things that have happened that are on the docket, so to speak, today, are crystal clear. If the law matters at all, and if this Florida Supreme Court utilizes the law in making its ruling, then Algore doesn't win. There's no way he can. The secretary of state of Florida, Katherine Harris, according to the law, must be affirmed. The recount is proceeding in three counties, each with three canvassing board members. So you have nine board members with total control over recount rules and standards in these counties - and eight of those nine players are Democrats. The decisions of these members are going to be reviewed by the seven-member Florida state Supreme Court. Who sits on the court? Well, all seven justices were appointed by Democratic governors. Six are registered Democrats, one is a registered independent, and all are liberals. Let's say seven Democrats because that's the way we're counting it up. Add the canvassing board members to the Florida Supreme Court and you get a total of sixteen Democrats, zero Republicans. Judge Terry Lewis, who ruled on Katherine Harris, is a seventeenth Democrat. The state attorney general who's fighting that ruling? Another Democrat. Do you see what this means? Seventeen out of eighteen players in this are Democrats, yet the argument is that the Republicans are trying to steal this. Is there anything more absurd than that? For those of you saying, "Rush, you're making too big a deal out of this," let's turn it around. Say Algore leads by 930 votes as the deadline for certifying the election passes. At that point, the Republicans demand a hand recount in counties where they hold nine-out-of-nine canvassing board positions. Now let's say that seven out of seven Florida Supreme Court members are Republican-appointees. Would the Democrats sit idly by and accept this? Would anyone accuse the one Democrat of stealing the election from the other eighteen? This is the sense of proportion that is always missing. The lone Republican in all of this, Katherine Harris, has done nothing except uphold the law, yet we are told that the Republicans are trying to steal this election.
