It probably hinges on whether dimpled chads and 1 corner detached chads are allowed to be counted. I listened to some of the Supreme Court hearings Monday. I have a gut feeling the justices will find it most disturbing that the criteria for a valid ballot is being changed during the process. I think there was some precedent in Fla. of a 2 chad detached criteria being used in the past.(not sure on this) Apparently, that was the original criteria in Broward and I think Volusia county as well. Eventually, this criteria issue will have to be adjudicated since it will be the DECIDING issue. Up to now, EVERY issue of material importance has gone in favor of the Democrats. (including the courts) When it becomes obvious that the final issue of the criteria will ultimately decide the outcome, I think the court may think long and hard and determine the original criteria (especially if it had been one of record in Fla.) must be used. Common sense tells me that a change of criteria in mid process that ultimately has the effect to change the outcome of the election is simply not a precedent that the court will allow to be established. I hope the court uses its common sense to see it the same way.
