Estrich Predicts Supreme Court Victory for Bush

As Florida's Supreme Court ponders whether Secretary of State Katherine Harris has the right to disallow questionable hand recounts in the state's presidential election dispute, at least one loyal media Democrat thinks Al Gore is fighting a losing battle.

Sunday night, Susan Estrich, who managed the 1988 presidential campaign of Michael Dukakis, predicted to Fox News Channel's Hannity & Colmes that Harris would be upheld in both the state and U.S. Supreme Courts:

COLMES: What's going to happen tomorrow, Susan? What do you predict?

ESTRICH: I...

COLMES: Can it all be over?

ESTRICH: I'm predicting going against the grain and not what I want but just what I'm predicting.

ESTRICH: If it's not tomorrow, the next morning. The justices will look at this situation -- the Republicans have won the spin more about the military ballot and the proof of people eating chads has...

COLMES: Would you advise Gore not to appeal if that happens -- not to appeal this...

ESTRICH: Oh, I -- I don't think -- you know, I think if the justices affirm her tomorrow, then, of course, they'll appeal because they're trying to win their case and the presidency is at stake. But my prediction would then be that the U.S. Supreme Court will say that there's no federal constitutional right to a hand count.

Minutes later, Estrich elaborated on what she thinks Florida's Supreme Court will do regarding Harris.

ESTRICH: This is about an election, and I don't think they're going to favor Al Gore because they're Democrats. The easiest thing for them to do tomorrow is just to uphold her and say...

HANNITY: Right.

ESTRICH: ... "Look at what the nightmare is going to be if we don't."

HANNITY: Is that what you think is going to happen?

ESTRICH: I'd put my money on it, yeah
