What you don't realize is that the supreme court did not ask any questions because they didn't already know the answers or likely answers. Those questions were designed to cross check the presentations. Did either side or both have a coherent argument, or was it a string of unrelated proposals? The case had been presented in written form already, the justices were filling in the blanks, which are usually the weakest points in a case.
