you are right...but I really believe Boies helped them along by telling them exactly how to achieve it.

Bush and Harris team wanted to go by the law on the books. They argued against SC making up their own laws and rules. How could they at the same time argue that it is ok to make up rules as they go, but make the rules more favorable to Bush?

Gore team (the 7 justices plus Gore lawyers) were set on writing their own laws in that courtroom, that's why the exchange was more like collaboration, search for cover on part of SC. It wasn't really questioning.
