The right to count dimpled ballots always existed at the county level, but that right was never exercised in past elections because numbers to certify a winner were obtained through a regular hand count of hanging chads. In other words, no need for Step C if Step B shows a candidate winning by 300 votes and there were only 200 disputed ballots.

Therefore, no rules were changed mid-stream.

The courts have been consistently clear in this area: dimpled ballots do count, if they are consistently dimpled, and not a mix of dimples and open windows.
