The SOS issued her Cert. She then gave Dade, et al the right to request to file an "amendend" cert. They did.

Dade county counted some sample precincts by hand. They concluded (at that time) that the error is too small to proceed with countywide recount. What they requested in their letter was to include the result of their sample recount in the overall count. It amounted to only about 4 votes for Gore.

The court asked: Don't we have a CONSTITUTION problem if we count just some. Bush attorneys: Hey no problem, WE WON'T ASK FOR A RECOUNT OF THE ENTIRE STATE, so you have an out. (Oh, my.)(sigh!)

I must have missed this part. I was watching RealVideo on cspan.org and I lost some parts. But I think that was a mistake by Bush lawyers. They should have said that it would be a constitutional problem, and if FL SC court wants to go ahead and completely rewrite election law after the election they are free to do so, but the next round would be in US Supreme court.
