My job is to apply the law." On another occasion, Holmes said that his job was "to see that the game is played according to the rules whether I like them or not."

Judges who think it is their job to produce "fair and just" solutions to society's problems undermine the very essence of law. The rule of law means having rules known in advance and applied to everybody. You cannot have that if judges are going to wing it and base their decisions on what they personally happen to think is fair and just.

A few quick political points:

1. FL Supreme court had contradictory laws to resolve. Their decision will also have long term implications for not only FL but other states as well.
2. Republicans had more than one chance to ask for statewide recount.
3. Yes, the sleazy tactics and character assassination efforts against SS Harris are despicable and part of the reason people are turned off to the political process in general and the reason that someone like Nader can come along and throw the election into deadlock.
4. Texas allows dimpled ballots to be counted in hand recounts.
5. The two-party system, utterly under the control of monied interests was headed this way inevitably because they each seek the center and collude to enact exclusionary legislation against third-party challenges.
6. The next president will get nothing done for two years because neither party has the votes to end filibusters. No tax bill, no Supreme Court appointments, many many other judicial vacancies will remain unfilled. Look for bitter battle in 2002 Congressional elections.
