You mistake the legal meaning of "abuse of discretion" (more or less, 'beyond allowable authority') with the ordinary meaning of "abuse." Two completely different things.

It's going to be interesting since Gore's team has maintained all along that the boards were the ones to make the choice whether to recount or not. Now they will sue and attempt to make the case that only the Gore campaign has the right to decide whether there is a recount or not. Cool.
