His reason for stating it was that the court has intervened before in similar matters. The supreme court has made it clear that when a state's rights interfere with the national right's than they step in. He stated that they had in prior cases slapped the hands of judges who attempted to block the legislature from legislating.
In reality if the FLorida court can do what they did then why bother having elections ? Just let the courts decide.
