They had days and days after the election to work out guidelines for ensuring a fair result. Indeed both laws have been on the books for years, IIRC. A discarded military vote that was cast on time certainly represents a failure of the system to register a voter's intent. But so does a voter in Palm Beach County who will sigh an affidavit that she mistakenly voted for Buchanan because of a confusing ballot.

mike, I have never heard a clear explanation of how military ballots were handled in previous elections. I have heard several people (not connected with either campaign) say that there were always a lot of discards among them; but probably nobody ever made a fuss before. The law I have heard cited is the Florida law, which requires a postmark. When both sides are scrapping for votes, do you really expect the Democrats to say "this absentee ballot has no postmark, or is dated after Nov. 7, so it's clearly illegal, but what the hey, it may be from one of our brave servicemen, so let it in anyway." Ain't gonna happen. I don't think the Republican willingness to fling charges of unpatriotism is very helpful here, and just adds to the bad blood.
