Monu the Supreme Court is a complex place. These judges become very close and they have a lot of respect for each other. The burden they have of knowing that the future of all will weigh on their decisions causes them to often throw aside personal leanings. That is also why they like to refer to prior decisions. The law professor from George Mason stated that precedents would favor the Bush arguments.
They also know that if elections can be decided by lawyers and that to win an election simply means changing the rules at whim than we are headed for deep trouble.
