COSSACK: I don't think it's strong. You have to have a federal question in
order for the U.S. Supreme Court to accept the case. Bush's argument is that
selective hand counting means all votes are not being treated equally so he's
asking them to stop all the hand counting. But how ballots are counted is
presumptively a state issue. Unless (the U.S. Supreme Court justices) can see
that there was an incredible abuse of discretion -- like a poll tax was imposed or
something on that order -- this is the sort of thing they would leave to the states.

Q: What about the chances of Vice President Al Gore succeeding in his appeal to
the Florida Supreme Court to force Miami-Dade County to resume hand
counting votes?

COSSACK: The Gore team's argument is as follows: Once you take a sampling
and once you find there is a tabulation error, then you must recount. But the
Circuit Court last night denied Gore's request and that's why Gore is before the
Supreme Court. The (election workers) said, "You gave us a deadline to get it
done by Sunday. We can't get it done by Sunday. We're through counting. You
count. We don't want to count anymore." One could almost describe it as an act
of civil disobedience. I don't know how you enforce an order to keep counting
because the election workers are volunteers.
