AMD uses ASM tools, and ASM started shipping its .13 capable 248nm tool set several months ago. AMD's .13 lithography process has been set for some time, they aren't satisfied with their yields because of problems during the polishing process at this point, so they have been holding back full scale production.

They might have solved the polishing problems last month, or they might still be stymied by them next year. We won't find out either way until the .13 chips start showing up.
