They will not say that the "Florida electoral scheme" is fundamentally flawed. That's absurd.

They can say or hold anything they want whenever they want. The Bush campaign has argued the Florida law, as construed and applied by the Florida Supreme Court, is "fundamentally flawed" and therefore violate the "due process" and "unequal protection of laws" clauses of the US Constitution. The court can agree with then and then proceed to fashion any remedy they wish. Watch for the unexpected. Be careful what you wish for because you might get.
