It's pretty well established in election contests that if one side concedes that renders all pending litigation moot.

Gore has already said that he won't concede as long as there is breath in his body. But assuming that he did, the appeal to the US Supreme Court would be moot. There is a requirement that there be "an actual case in controversy" for an appeal to be heard.
