Wrong. Pursuant to the 12th Amendment, Gore needs a majority of "the whole number of electors appointed" on November 7, that is, 270 of 538. 538 Electors were appointed by the people on November 7, the problem with Florida is that the 25 Florida Electors have not been certified. BTW, Florida law provides in the case of a vacancy the Governor can appoint someone. But Jeb Bush appears to have recused himself from doing that.

Federal law mandates that if a state has held an election for the appointment of electors, but has failed to make a choice in the manner provided by law, the state legislature may appoint Electors "in such a manner as the legislature of such State may direct."

I realize you Gore supporters are hoping that Gore can win by delaying until after the deadline, but it won't work.
