did 4 or 5 judges of u.s. supreme court have to vote in favor of certiorari? i understand 5 are needed to take case from a state's highest court directly. yet, ny times and others say 4 voted. 4 are needed to grant certiorari- but that is from u.s. circuit courts. in this case, i think 5 votes were needed.

also. it is stated that u.s. supreme court did not grant certiorari to bush on all his arguments. but, the other arguments are still before 11th circuit-so bush still has that string to his bow. it gives him a way to win on the equal protection argument-as that case is before 11th circuit. indeed, by u.s. supreme court taking certiorari on some points, it shows 11th circuit that federal courts can get involved in this election controversy.
