As a matter of law, Bush's case required five votes to grant cert., according to today's Washinton Post:

The Nixon case, like the Florida case, arrived at the high court through a request for an expedited hearing that would leapfrog the U.S. Court of Appeals. Court rules require that five justices--one more than the normal four--must vote to take a case on an expedited basis.
