COULD SUPREMES DECIDE VOTE ON 113 YEAR OLD UNUSED LAW?

It was entitled the "Electoral Count Act of 1887" and it doesn't appear that it has ever been used --- until now. This is the law the Justices of the US Supreme Court say they are going to consider when they deliberate George Bush's appeal next week.

Why are Democrats -- the same Democrats who have suddenly developed a strong affection for the "rule of law" afraid of this particular one? Well, because it's right on point -- it speaks directly to the actions of the Florida Supreme Court and the various county canvassing boards.

It's not a difficult law to understand. According to the Los Angeles Times story I have linked you to below the law says that "any controversy or contest" regarding the naming of electors has to be decided on "laws enacted prior to the day fixed for the appointment of the electors." Well, the Florida Supreme Court changed those rules -- changed them after the election. This would seem to fly right in the face of the Electoral Count Act of 1997. The various canvassing boards have been changing the rules too -- and changing them, and then changing them again -- while the count is going on! "THOSE PEOPLE HAVE A RIGHT TO HAVE THEIR VOTES COUNTED"

It's another one of the focus group phrases being used by the Democrats. If you're tuned to CNN, Fox News Channel or any other news source this weekend you'll hear the Democrats say that "every person has a right to have their vote counted."

Well -- sorry, that's not true. No matter how much the Democrats would like that to be the fact, it simply isn't. There's one word they left out. That word is "legal" and it goes right before the word "vote" in their little focus group phrase.

Every person has a right to have their legal vote counted.

So -- what's a legal vote? Well, about 25 years ago the Florida appeals courts said that every voter had a legal responsibility to exercise a certain amount of care when casting their votes. They had a responsibility to find their candidates name on the ballot and then cast a proper vote for that candidate. What's a proper vote? Well, the instructions are right there on the ballot. It's a vote where the voter punches the little chad slap out of the ballot with that stylus.

So --- follow the rules, find your candidate, read the instructions and cast a proper vote for your candidate and you've cast a legal vote. Then, and only then should it be counted.

SATURDAY MORNING.....

CNN has just reported that the "unofficial" Bush lead is now about 590 votes. Palm Beach County is reporting that they have 8,500 ballots left to "count," or, we should say, to scan for dimples, nicks, chips, bulges and whatnot.

Yesterday Gore was was reported to be winning one out of every three contested ballots in Broward County. This means that he may get as many as 600 votes before the recounting is done in Broward.

With the 8,500 disputed ballots in Palm Beach County, Gore only has to net one additional vote from every 15 ballots in Palm Beach to win.

So why was gore picking up one of three ballots in Broward County and not picking up that many in Palm Beach County? One word. Standards. The standards are different in Broward than they are in Palm Beach. In Broward they're aggressively counting dimpled chads. In Palm Beach they are not.

Do you see why both sides are screaming? Gore wants Palm Beach to apply the liberal standards being used in Broward. Bush thinks that the Broward standard is unconstitutional.

In the meantime, both sides are waiting for some court decisions as to whether or not those tossed military absentee ballots should be counted.

I don't know, folks. Does this look like any way to run an election?

Like Stalin said. Those who count the votes decide everything. The organized grand larceny is working! An election is being stolen.

Let's put a fact on it. Let's put some names to the men and women serving in the uniforms of our armed forces overseas .. men and women who were actually in the Democrats cross hairs last week. NOW IT’S REPUBLICANS DEMONSTRATING – AND THEY CAN’T STAND IT.

They're still screaming about it on Saturday morning ... the demonstrations, I mean. Those Gore supporters and Democrats just can’t get over that demonstration the Republicans conducted earlier this week in Miami-Dade county. How dare they? Democrats demonstrate, not Republicans! Demonstrations are a leftist sort of activity – a collectivist activity! After all, everyone knows that Democrats are so much easier to organize into mindless mobs than are Republicans. It goes hand-in-hand with the lack of an individualist mentality.

So – when the Miami-Dade politicos headed behind closed doors to count some ballots out of the sight of the media and the public, Bush supporters reacted! They saw something happening that they didn’t like – and they let it be known! Finally! Angry, demonstration Republicans! Who would have thunk it?

Well … if the Republicans are going to start horning in on Democratic turf and start demonstrating, then the Democrats are just going to have to try to punish them for it. So --- the word goes out quickly. Blame the Miami-Dade decision not to do a hand count on the Republicans! Claim that the officials were intimidated! Even afraid! Don’t mention that there was no way in the world for these officials to complete the hand count in the time allowed by the Democratic Florida Supreme Court! No! Not while Republicans can be blamed!

Then --- trot out Joe Lieberman to really turn the screws a bit. Get Lieberman to call for calm – to call for an end to the demonstrations!

Here’s part of what Lieberman had to say on Friday:

I am deeply disappointed by reports of orchestrated demonstrations on Wednesday inside a state building, a government building, in Miami-Dade County, not just to express a point of view, but to disrupt and halt the counting of ballots.
These demonstrations were clearly designed to intimidate and to prevent a simple count of votes from going forward.
This is a time to honor the rule of law, not surrender to the rule of the mob.
This is a time for patience and respect, not intimidation and violence. According to one network news report last evening, the demonstrators in Dade County were guided by, and I quote, ``a Republican public relations officer,'' end quote.
These demonstrations are a disservice to our democracy. And there are now reports that these very same methods may be taken to Broward County for similar demonstrations and similar disruption.
Vice President Gore and I call on the demonstrators, and all who may be organizing or encouraging them, to stop these activities immediately. And I hope that Governor Bush and Secretary Cheney will join us in this call.

Now – and question for Joe Lieberman. He won’t answer it, so maybe you can come up with a good answer for him!

Hey, Joe! Where the hell were you when Jesse Jackson was leading demonstrators through those Palm Beach and Miami-Dade counties with chants of “No hand count, no peace!” Where was your request for “patience and respect” while Jesse was marching? Were those demonstrations a “disservice to our Democracy” as you say? Why are you and Gore calling on the people who organize or encourage these demonstrations to “stop these activities immediately” now? Why weren’t you making this request when your pall, our nation’s preeminent publicity whore Jesse Jackson was fighting your fight in Florida?

Does anyone else smell a bit of hypocrisy here?
HOW CAN GORE LEAD AS COMMANDER IN CHIEF?

"I can properly describe our attitudes toward the Democrats, specifically Gore, as being of an overtly contemptuous nature and to the point of being furious," said a senior Army enlisted soldier in Germany. "I have contact with hundreds of soldiers each week. I cannot say that even one single soldier displays any level of respect for this man and the actions of the Democratic Party. I have a number of colleagues who have already prepared their resignations and retirement requests who state that they would 'refuse' to serve in a military commanded by Gore."

Who said that? A senior Army enlisted soldier in Germany said that. The orchestrated attempt on the part of the Gore campaign to deny a vote to military men overseas has our armed forces hopping mad. Simply put, they are not prepared to accept Al Gore as their Commander in Chief.

What we are facing here is more than a stolen election. We are facing a dispirited U.S. Armed forces that may have to face some rather serious threats from countries such as China and North Korea, not to mention continued troubles in the Middle East.

You Democrats out there ---- aren’t you so proud of your candidate?

GORE DESPERATION DEEPENS

It looks like the Florida Secretary of State will certify Florida's numbers Sunday evening, or possibly Monday morning. Now I think that they are going to find enough Gore votes in those dimpled, pregnant, expectant, hungry, horny, impotent, angry, sad, depressed and hyperactive chads to swing the victory to Gore by a few points. They didn't find those votes in Broward, but Palm Beach is using a different and more liberal standard. It ought to be enough.

IF, however, --- and I think it's a big if --- there aren't enough strange ballots in Palm Beach to allow Gore to steal this thing, Gore says he's going to refuse to concede and he will contest the election.

Well --- that's what Gore is saying. I think it will turn out somewhat differently. If the State of Florida is, by some chance, certified for Bush the Democratic leadership in the House and Senate is going to pay a little visit to the Vice President's residence and preach the gospel unto him. They will tell him that enough is enough, and it's time to throw in the towel. Devastating news for Gore. This man's entire life has been focused on this race, this opportunity to become the most powerful man in the world. So, where would he go from here?

Again --- I think he's going to the White House. More later.

FULL FAIR AND ACCURATE COUNT?

How many times have we heard this focus group phrase over the past three weeks? Well, I hate to be the one to tell you, but the standard to be applied in Florida is not a "full, fair and accurate count of all votes." There's one word left out there. One word that the Gorons don't particularly want to deal with. The word is "legal" and the Democratic focus group phrase should read "a full, fair and accurate count of all legal votes." According to the instructions on the ballots themselves, on the voting machines, and on signs hung in the polling places a legal vote is one where the stylus tool is used to punch all the way through the ballot. That, then, is the standard. A full, fair and accurate count of all votes where the stylus was punched through the ballot. Rule of law, you know --- not the rule of partisan canvassing board

SOME LISTENER COMMENTS:

If Joseph Lieberman had been the candidate to have a heart attack instead of Dick Cheny, how many minutes would it have taken before we would have heard democrat spokesmen on TV blaming the GOP for it? They would have claimed it was brought about by grief caused by the Republicans trying to deny Americans their right to vote (you know, a broken heart).

What if, in Florida, it was a Black Man barely in the lead for President with a White Opponent and the White Opponent wanted a “hand count” in three “white only” counties? Further, the all White “canvassing board” voted unanimously for the hand count. Would anyone have a problem with this?

I saw you on Larry King Live--now there's someone who ought to be on radio. Donna did a good job with your outfit. It was very neat and attractive and so were you. You are a distinguished stud. What attracted me was the way you handled the questions. Of all the radio hosts, you were the most articulate. You are not the Grinch I imagined you'd be, Santa can leave you in my stocking anytime.

Republican observers objected when board members began looking for party-line Democratic votes down the ballot to bolster their arguments to count some indentations for Gore. Circuit Judge Robert W. Lee, the canvassing board chairman, said partisan voting patterns should be considered along with other factors, but is "no more or no less than some evidence of intent. It is not conclusive."

I happen (sic) to see you on Larry King last night and frankly, I was disappointed in your embarrassing performance. You were completely outdone by Raul, Armstrong, Ronn and Jim. Obviously, you were completely out of your element as you couldn't interrupt, out shout or cut off the other guests like you do to the callers to your show. Apparently, the host knew what a rude asshole you were and seldom asked you for any input. BTW... I am surprised that you aren't a Democrat. After all, it was Jimmy Carter who let you come back from Canada after the Vietnam War was over wasn't it?
