When I first moved here 11 years ago, lawyers in Fairfax didn't play hardball, and the judges did not want it introduced. But now a lot of the lawyers on the Fairfax bench are from large firms that have offices in Washington and Fairfax, and they are used to hardball and expect it and even admire it, so it's common here, too. Scorched earth, leave no stone unturned, never let up the pressure, never give up an advantage, never give quarter. I have learned how to do it, too. If the client has the money, it's a very lucrative practice, because it really burns up the billable hours. However, for the type of clientele I have, it only pays off with a really worthwhile medical malpractice case. I had one divorce where the client was ready to pay the freight and my total bill was $35K. That's very unusual for me, although there are a few specialists who do that all day every day. Boies is a very good practicioner of the art of hardball, and he's got a good team, but the thing that turned my stomach about Boies was his proclaiming, before the US Supreme Court granted cert., that there was no federal issue, and after the US Supreme Court granted cert., was saying that it was good that the Court had taken the case because it would provide finality. I don't think you do your client any service by always claiming that every ruling is a victory for your client. I don't think there is anything wrong with saying, "we are disappointed, but confident we will prevail." If he can't work up a little righteous indignation once in a while, he's just another empty suit. I was pleased that Baker and Bush were able to get on the TV and project genuine anger. To me, they acted like they felt they were being cheated. Even Liebermann was able to do that. Where is Gore? Where is his anger? Where is his righteous indignation? Could it be that he doesn't have any?
