I am not a lawyer, but from what I am reading, the Florida Supreme Court may not have acted properly. There were two laws that were somewhat in conflict, and the Florida Supreme Court thought the happy medium was to delay the certification. However, the Bush argument is that the Florida Supreme Court can't change the law between the election and the final count - which may be correct - and provide the reason that the U.S. Supreme Court took up the case. So my guess is...

The U.S. Supreme Court might well uphold the first law that Katherine Harris was allowed to certify the election the first time round.

At the same time, they may well uphold the second law that allows the Democrats to ask for a recount - and contest the election. In that case, we may see that Dade County will be asked to continue with their hand count, and if the election comes out different, overturn the certification.

Bush may have made a mistake taking this to the Supreme Court, although it probably would have ended up there anyway.

Boies did not misrepresent the Illinois ruling to the Florida Supreme Court. The erroneous affidavit, which people have been trying to use as proof of this, was actually written AFTER the Florida Supreme Court ruled.
