You make some excellent points. What is interesting is when the experts sue each other over this. Consider Kirk Kerkorian who filed a $9 billion lawsuit against DaimlerChrysler. My understanding is he didn't understand what a "merger of equals" meant even with his team of lawyers.

I think it does have to come down to buyer beware in the end otherwise it is just a battle of who has the best lawyers and buys the best judges through appointments to the courts by paid for politicians.

Sad, but true.
