I think that the Gore campaign is not pressing the issue because these were not the ballots, and thus throwing out 17,000 ballots would disenfranchise those voters that did everything right. If they could find a way to get a list of those ballots applied for while committing a "third degree felony" (if one believes the article), then Gore could go after these, but disenfranchising another 12,000 voters for the "sins" of 4700, ain't nice. It could be "legal" if a judge so decides. Apparently, the regulation was in place because there was fraud associated with absentee ballots in prior year, and there is really no certitude now that all these ballots were indeed filed by voters and not "ghost voters".
