It's only the true gap, close to open, that concerns. Doug's said "Any gap is meaningful," but you do have to at least discount bid and ask. If you can do it by percentages, I'd err on the safe side with one percent.
BTW, is your scan putting in for the volume significantly higher than previous three days on the signal day. That exact measure has never been decided on/investigated, but it should be in excess of 25%, IMHO.
