A machine is a tool. Does it require moving parts or parts at all to be a machine. Is a stick a machine?

I think you are stuck on terms here, but I see where you are going. Maybe a voting station is more accurate. Or a voting table.

It really matters not what it is called. It matters what it allows someone to do. In this case it allows someone to register a ballot and select a specific area of that ballot to accept a mark.

As for parts, it has a sleeve, some location pins, a stylus, and a cover so no one can see that you voted for Gore and then laugh at you (ok I made up that last part).

I think Boies is already going where you are going and the judge is going to have nothing to do with it. Bet on it. This judge may play dumb, but I don't think he is.
