I believe that the founders would have wanted the states to decide. But the founders weren't always right. It would also depend on which founder you were referring to... (my American History knowledge isn't what it used to be, but I remember something about a Hamilton being a staunch Federalist) The question of whether it matters what they would have wanted is a tricky one. My honest answer right now is that I don't know, - need to put some more thought into that one. I'll get back to you.
