That IS the key. For the SC to accept the case is already 2 strikes against aLgORE. Usually, the only time they accept cases that will lose is when the case is like a LOT of others and a question of law and interpretation of the Constitution is needed to guide those cases.

FWIW, I have read over 200 SC cases as a hobby-- mainly 1st, 2nd, 4th, and 10th Amendment cases...
