Timothy, this was an incredibly unusual case for the Court to accept. I can't name a single Constitutional expert who predicted that the Court would grant cert. because of the nature of the question and the repercussions of overruling the State S. Ct. of Florida. The discussion amongst attorneys and Con Law Profs is that the Court granted cert. because of the smear campaign that Jim Baker unleashed on the American court system when he criticized the Florida S.Ct.'s decision. The S.Ct. has wisely accepted this case in an effort to restore integrity to the Florida court, and at the same time all courts across America. The S.Ct. will treat the Bush side quite harshly, I will predict, because of their ridiculous attempts to undermine the legitimacy of the American legal system. At least 2 members may recuse themselves from the proceedings. Souter and Thomas because they were appointed by Papa Bush. Additionally, Rhenquist may do so because his son works for the law firm representing Bush (or so I believe I read yesterday). In any case, I doubt that Bush will find a single justice to side with him.
