Now, Ken, honestly. If the argument is correct that the Florida SC overstepped the line by being judicial activists (instead of using judicial restraint) in writing new law (which it did, imho), then for the US SC to step in and arbitrate between the rights of the legislature and the rights of the Florida SC is ENTIRELY APPROPRIATE. The Florida SC is not the end-all, know matter how much you'd like to think that it is.

In the end, I feel much more comfortable with our US SC Justices making a decision over any state's SC (made up of judges who are not appointed for life).

Why are you afraid of the US SC weighing-in on this?
