Seems to me that it is Gore's due process rights that are being violated. The Florida law clearly provides for a right to a hand recount when requested. The hand recount was requested but not done. The judge has an opportunity to prevent irreparable harm from being done by the passage of time. When that drop dead deadline of December 12 arrives, a hand recount showing Gore won the State of Florida will not matter. It is still possible to count those ballots if they start on Sunday. Imagine this scenario, Bush gets installed by the electoral college. Then, it is discovered that Gore had enough votes in those disputed ballots to turn the election. Then we have an illegitimately elected or at least disputed President. Then Bush wins in the short term and loses in the long term because he has an impossible task of uniting the country.
