While you(and no doubt a zillion others) are trying to figure the SC score, how about figuring out how the US Supreme Court is going to manage to avoid undermining its own stature in the eyes of the nation(world)by appearing to be just as partisan as all the demonstrators out front.

This is not looking too good.

I agree in general. But I don't think they will come down with a 5-4 vote either way. Too polarizing. So one side will get 6 or 7 votes.

The big point, IMO, is that when it comes to construing a FEDERAL statute, the USSC owes no deference to the FSC. It's like the marijuana laws -- even if a state court says our state laws make marijuana legal, do you think the SC is going to say "okay, the state court is the boss of state laws, so we're going to say okay"? No. They say "hey, our statute says x and that's the law." That's why I would have pressed really hard for the point that I was asking the USSC to construe and apply the federal statute. Which maybe they did -- I've been to busy to review any of the oral argument or even the briefs.

And just got 26 pages of briefing dumped on me 15 minutes ago I have to go deal with!
