Yeah, a lawsuit is null if that option is employed. Congress is a factor, though.
They COULD refuse to recognize the FL legislature's electoral delegation. If there is no other delegation from Florida, Gore wins.
If somehow there are two delegations, one from the legislature and one the result of a sleazy Demo "recount" and Congress recognizes the sleazy bunch, Gore wins.

I'd buy puts on both those options, though.

You may not understand the power of the trial lawyer. Thanks to the Republicans the President can be sued for actions taken prior to taking office. Bush may be spending all of the time he is not in Crawford in the courthouse.
