She suggested that the 15,000 disputed ballots in Seminole were more important than all the rest of this legal mumbo-jumbo. Bush's lawyers have been busy making the case that only fraud is sufficient reason for a recount. Gore has countered their noise. One might think that Bush was engaged in "delaying tactics" but my friend suggested that it was Gore who was delaying things. She said that there might not be enough votes in a recount to make any difference. But that Gore was holding out for the fact that he could gain ~4,000 votes and win Florida if and when some judge woke up to what happened. By news reports, Republicans in Seminole County took home thousands of votes and illegally corrected them. And, when at least one Democratic candidate asked for the same privilege, he was refused. It is absolutely, positively, against the law for anyone to alter a ballot after it has been first cast. Florida law says this clearly. And to make it all clearer, the State's refusa to honor a Democrat's request for equality eliminates all chance of argument on grounds of fairness. Alterring those ballots was a crime. IMHO, some people should go to jail. Whatever judge rules first on this issue has no choice but to disallow such "tainted votes". Whether you are a fan of Bush or Gore, it does not matter. Alterring a ballot is consoder "fraud" under Florida Law -- and fraud is the only reason for adjusting the ballot count that neither side has argued. What is, is. The first ruling is due this Wednesday, December 6th. Which, conveniently, is the last day anyone can reasonably expect to have electors chosen in time. IMHO, everything that has come before or will come since will end on Wednesday. The U.S. Supreme Court has chosen to play it safe and kick everything back to the Florida courts. If Gore gets the expected adjustment in Seminole County. he wins. If that judge chickens out and defies Florida law, Gore loses. When you boil it all down, some circuit court judge in Florida will decide this election. And the rest will be history. Whatever happened to your vote? Or mine?
