Ther judicial branch interprets legislative law. In effect, that is making new laws. But the thrust of the article is that there may not be existing Florida law preempting FSSC from interpreting the deadline for federal elections. So the matter is then whether there is federal law. Which there is. But the Court may be hesitant to make such a bold statement as to the effect that no one has the right to vote. --I am not lawyer, this is just my interpretation of one article.
