I've seen various articles that say pretty much the same thing. Until the IRS rules as to what "substantially identical" means in regard to options it's pretty much a judgement call. IMHO if both date and strike are different then you're safe. If the strikes are the same or the dates are the same then it's less clear, especially if you roll from one OTM to another OTM with the same date.

Of course, the IRS may decide to get really technical and start comparing risk/reward profile graphs. Then you're pretty much screwed.
