The only way I could see Sauls not counting the M-D ballots would be on the grounds that these ballots could not possibly affect the outcome of the election, a very difficult position to take.

He could also say that the evidence (ballots) has been corrupted over time and that there is no way to determine the true voters' intent.

Normally I would agree with you except the USSC just made my whole point, they threw out the FLSC ruling giving Gore an advantage by giving him more time, because it changed the rules after the election. They said tell us why you (FLSC) felt you had the right to change the rules as you did and we will look at it again, if not, all reverts back to the original Nov 14th date no matter what Boies says on TV. He is a real kick, no matter how he tries to spin it, vacated means thrown out. I would like to see how he (Boies) feels about the USSC now giving the FLSC another chance on their original decision with all the true facts rather than the lies he (Boies) originally submitted to them. Things just keep getting better and better!!
