Well, I really don't know, I haven't read the opinion, but it occurs to me that the USSC COULD have justified the FSC, if the FSC could have been sustained on ANY of the four grounds listed in the FSC opinion.

Lawrence Tribe is spinning this as a non-event, but it could be a sort of notice by the USSC.

I am not so sure, at this time whether it was not intended as a "shot across the bow" of the FSC.
