Why shouldn't it be decided on public opinion?

For the same reason that any lawsuits shouldn't be decided on public opinion. I don't think Gore shouldn't concede just because public opinion goes against him, if he doesn't want to. Likewise, I didn't think the Clinton impeachment should have been affected by public opinion, but it was. I'd rather the results be a little more objective, but it'll never happen. <G>

Another reason why we shouldn't use public opinion -- it's too mercurial. If we're going to use public opinion to decide the fate of the election after the election (and ignore the legal issues), then why not use it before the election. But when would you take the official poll? When Gore was ahead in the polls? When Bush was ahead in the polls? What if we found out tomorrow something fairly bad about Bush (but not illegal) that swung public sentiment away from Bush and back towards Gore. Should GWB then concede? What would it have to do with the election and the issues about ballots being decided? There have been quite a few presidents that have served through periods of low public approval. Should they have been thrown out of office and a special election held? Should Carter have been drawn and quartered? <G>

If you decided things on public opinion, or let it sway you too much, we'd have a system built on constantly shifting sands with no stable base on which to build a government.
