His main concern as a judge is not getting reversed, as his friends at the Fla SC just did. As a result, I think there's a better than even chance he will now tell the Gore team that it's over...

Because if he was relying on the FSC decision in part or whole to justify ordering the recount, he has to reconsider his basis. And if the USSC decision is taken to say go back to the rules as of Nov 7 and quit using judicial discretion, he has to take that into account.

I don't think it will hold up his decision forever; he won't, IMO, wait until the FSC respeaks; but he would be a fool to issue a decision that didn't take into account the USSC decision.

Sauls is smart and isn't about to step in front of a freight train. I suspect what he's really waiting for is some indication of what the Florida State Supreme Court's next move will be now that the USSC has thrown the case back to them.

Of course the clock keeps ticking, but there's not much the Gore team can do about it. Except, perhaps, to stare a little longer at the writing on the wall and take the opportunity to bow out with what little grace remains.

I wonder what happens with Broward. Gore didn't contest that one in front of Sauls. In view of the USSC judgement, is the Broward recount which netted Gore several hundred votes thrown out? If so, can Gore amend his contest to include Broward along with Nassau, PB, and Dade? Do they have to have another mini-trial on Broward?
