To: swisstrader who wrote (100957 ) 12/4/2000 6:03:26 PM From: margie Respond to of 769667 I don't think the Florida Supreme Court will even hear the case. The FSC has been reprimanded by the United States Supreme Court, in a politically correct move, to avoid embarassing them. The US constitution is quite clear in this matter. Every single Supreme Court Judge, even Judge Ginsburg; mentioned that the legislature has the duty to chose electors; if there is any controversy. And it was Justice Ginsburg, a Democrat, who gushed over respecting the Florida Supreme Court and who wanted to give the FSC the benefit of any doubt. She was the one who said it should be remanded for clarification. I don't even think Breyer had any good arguments, after his obvious prejudice against Harris and Bush was revealed. Judge Breyer actually said to Attorney Klock during the US Supreme Court Hearing "And now the secretary has certified the winner. And therefore, I guess, WHETHER WE WIN ~ whether your side, the side your supporting, wins or loses, it doesn't change that." "WE" must mean Gore and I. apparently, BREYER is good friends with Al Gore. Breyer was also the only dissenting opinion in the 8-1 decision of the US Supreme Court not to hear Microsoft's appeal, that sent the case back to the US. Circuit Court in Washington. Breyer gave an unusual two page opinion in the Microsoft case, which sounded like the same bs that Microsoft's competitors claimed. The Florida Supreme Court knows that Boise lied, when he submitted that false affidavit about the Illinois case to them, which they used in making their now vacated decision. Boise submitted a sworn affidavit from a lawyer involved in a case 10 years ago claiming that a judge had said dimpled chads should be counted as votes. The judge actually said they should NOT be counted. The Gore team withdrew that affidavit. Duh. Ever since, the FSC has rejected everyone of Gore's appeals. Boise is under investigation for submitting that false affidavit by the National Legal Ethical ...something. I can't imagine Democrats will continue to support Gore. Craig Waters, who speaks for the Florida Supreme Court, is going to speak this evening; hopefully to reject the case or say they were wrong in their original decision; that changed the deadlines set by the Florida legislature BEFORE the election and that gives only the Florida Legislature the right to appoint the manner electors are chosen. This entire matter never belonged in the Courts. That is what the USSC has said. It should be determined by the Florida Legislature, and then by Congress. I don't believe Gore and Boise saying they will accept the decision of the FSC in this matter. They still have to say they will not accept the results of the Seminole trial; if it goes in their favor. They have to stop all litigation before December 11th; to avoid having jeopardizing Florida's electors. They will not be accepted by Congress if there is ongoing controversy; i.e. litigation. They will play it out; to demonize the Florida Legislature. Before it was Katherine Harris. Now they are targeting the Florida Legislature, as well as all Republican electors over the entire U.S.
