While the decision was a surprise to me; I suppose, in retrospect, it shouldn't have been. I think the history of the Court is that they really hate setting new precedent. They usually [not always] dodge it by refusing to hear a case or setting a very narrow interpretation [which they couldn't do in this case]. The only thing left, with that strategy was to "twhat"...the ball is back in your FSC. but they do know that the FSC will twhat it back to them. [thwat is not a legal term]
