Yeah, cool. I actually grinned when I heard that. It was very astute of Judge Sauls. It's actually really smart to have that as a New Rule. I hope nobody cuts that paragraph off the paper...

The key observation made by Sauls was that the individual counties were not voting for electors for president. They were merely contributing to an overall statewide election which awards electors on a winner-take-all basis. Therefore, the only proper recount for this sort of contest would have to be a statewide one and no evidence was produced by the Gore team that a statewide recount would likely change the election result. This was the essence of the intervenors' argument and I was very pleased that Sauls featured it so prominently in his reasoning.
