The 12/7/00 motion to dismiss was taken off calendar due to INFX' filing of an amended Complaint. The motion has been re-set for 1/26/01. Coincidentally, a settlement conference has been scheduled for 1/19/01 and a "tutorial" for the judge has been set for 1/18/01.

These are positive developments, in my view, for two reasons. First, I was concerned that if the Court declined to dismiss INFX' estoppel arguments, that might encourage the court in the Germany case to give greater consideration to that argument. Second, the timing of the tutorial and settlement conference, coming just before the hearing on the motion to dismissm, and especially since they are before the trial judge, increases the likelihood of a settlement.
